Primates for Sale in California - Are Monkeys Legal as Pets in California?

Monkeys are not ordinarily legal as private household pets in California.

California Code of Regulations, Title 14, Section 671 governs the importation, transportation and possession of live restricted animals. The restricted list includes primates.

A person may not lawfully bring a restricted primate into California, transport it through the state or possess it without the applicable authorization.

A permit is not automatically issued merely because an applicant has suitable housing, can pay a fee or has previously cared for exotic animals.

Review the California Department of Fish and Wildlife Restricted Species Permit page before making any decision involving a nonhuman primate.

The applicable regulation may also be reviewed under California Code of Regulations, Title 14, Section 671 .

Important: A USDA license, veterinary health certificate, breeder document or permit from another state does not by itself make private primate possession legal in California.

Why Does California Restrict Primates?

California restricts certain live animals because of concerns involving native wildlife, agriculture, public health, animal welfare and the risk of escape or establishment outside captivity.

Nonhuman primates can also present specialized disease, handling and public-safety concerns. Their intelligence, strength, social behavior and long lifespan make them unsuitable for many conventional household environments.

The restriction applies to the species classification, not simply to the animal’s size, temperament or whether it was hand-raised.

A young monkey advertised as tame, bottle-fed or domestically bred remains a nonhuman primate subject to California restricted-species rules.

California Restricted-Species Permits

California Department of Fish and Wildlife permits may be available for qualifying purposes such as certain scientific, educational, exhibition, propagation, rehabilitation or other specifically authorized activities.

Applicants may need to demonstrate that their proposed activity fits an authorized permit category and that the facility, experience, records, animal care and security arrangements satisfy applicable standards.

A person seeking only a companion animal should not assume that forming a business, nonprofit organization or educational program will create eligibility.

The Department may examine the genuine purpose of the activity, qualifications of responsible personnel, enclosure standards, public-contact plans, veterinary arrangements and compliance history.

California restricted-species permits are not ordinary personal pet permits. Do not advertise or represent a primate as deliverable to a California household unless the receiving party has valid authorization for that exact activity and species.

How California Organizations Should Verify Eligibility

A qualifying facility should complete every approval step before acquiring or transporting a restricted primate.

Identify the Species

Obtain the exact common name, scientific name, sex, age, identification and source of the primate.

Confirm Permit Purpose

Ask CDFW whether the proposed scientific, educational, exhibition or other activity is permit eligible.

Prepare the Facility

Complete compliant housing, security, sanitation, emergency and veterinary plans before acquisition.

Wait for Authorization

Do not purchase, import or arrange transportation until all required written permits have been issued.

The applicant should also verify county, city, zoning, fire, building, public-health, landlord, HOA and insurance requirements. A state permit does not necessarily eliminate other approvals.

Importing or Transporting a Primate into California

Restricted-species rules apply not only to permanent possession but also to importation and transportation. A person should not arrange shipment merely because the animal will be in California temporarily.

Depending on the activity, authorization may involve the California Department of Fish and Wildlife, California Department of Public Health, USDA APHIS and other agencies.

California public-health requirements can apply to certain nonhuman-primate importations, including temporary exhibition activities. Applicants should obtain case-specific instructions before travel.

Commercial transportation of regulated animals is also subject to federal Animal Welfare Act standards.

A qualifying organization must provide secure housing designed for the primate’s adult strength, climbing ability, intelligence and social needs.

Appropriate care may include controlled indoor and outdoor environments, double-door entry systems, secure locks, elevated resting areas, enrichment, sanitation procedures and quarantine space.

California’s varied climate also requires heat, wildfire, smoke, flood, earthquake and power-outage planning.

A permitted facility should maintain documented emergency procedures, evacuation equipment, backup power and arrangements with an experienced nonhuman primate veterinarian.

Nutrition, Social Needs and Enrichment

Capuchins, Marmosets and Squirrel Monkeys have different nutritional, environmental and social requirements. Qualified facilities should develop species-specific plans with experienced veterinary and primate-care professionals.

Feeding only fruit, human snacks or table scraps can cause nutritional imbalance. Diets may include appropriate commercial primate food, vegetables, controlled fruit portions and other professionally approved foods.

Daily enrichment may include climbing systems, puzzle feeders, secure foraging opportunities, rotating objects, manipulable materials and appropriately managed social interaction.

An animal’s care plan should account for its complete lifespan rather than only the relatively manageable size and behavior of a juvenile.
